Supreme court order to show causes letter on the former employee Mahato’s petition
Makawanpur. Supreme court has issued a notice to provide causes on the write petition by the W.H.O employee, Rajkumar Mahato with the Ministry of Health and Population, Office of the Chief Minister or council of Ministers of Bagmati State and Senior Public Health Administrator of Ministry of Social Development, Satish Bista.
A single bench of Justice HarikrishnaKarki has issued order to show cause on Kartik-21 within 15 days.
According to the former employee Mahato, the Ministry of Social Development ,Satish Bista and W.H.O have tried to remove him out of the Job due to the Caste discrimination, harassment and Injustice in violation of Article 4 and Article 33 of the Right against Untouchability and Discrimination, which are provided as a fundamental right in the preamble and Article 24 of the Constitution so the writ petition was filed in the Supreme Court against the removal.
He had also requested for the help saying he has been tried to be removed from the job in a press conference.
The preamble to the Constitution of Nepal and Article 940 of the Right against Untouchability and Discrimination, which are provided as a fundamental right in Articles 24, state that there is no discrimination in the workplace with or without Untouchability on the basis of ethnicity.
However, Bista, a senior administrator of the ministry said in a press release that he had been subjected to mental torture, workplace harassment and racial discrimination based on his color and caste.
“As I belong to the Madhesi community in accordance with Article 18 of the Constitution of Nepal, instead of protecting, empowering and developing me positively, i was constantly harassed and abused misusing their position and authority,” Mahato said.
Bista, a senior public health administrator at the ministry, told Tu Khabar that he did not discriminate against anyone on the basis of caste. He claimed that WHO staff was not needed in the ministry.
